1. About Kidverse Pune
Kidverse Pune (“Platform”, “we”, “us”, “our”) is a technology-driven discovery platform that helps parents and guardians find, explore, and book workshops, summer camps, events, and activities designed for children in Pune and nearby areas. We operate solely as an intermediary marketplace and do not organise, deliver, manage, or supervise any event, class, camp, or activity listed on the Platform.
These Terms of Service (“Terms”) govern your access to and use of the Platform, including any bookings, accounts, or services facilitated through it. By accessing or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy and Disclaimer.
If you do not agree to these Terms, please do not use the Platform.
2. Eligibility
To use the Platform and create a parent account, you must be at least 18 years of age and legally competent to enter into a binding agreement under the Indian Contract Act, 1872. The Platform is designed for use by parents, guardians, and responsible adults acting on behalf of children. Children may not create accounts or directly use the Platform without a parent or guardian.
By registering, you confirm that all information you provide is accurate, complete, and up to date.
3. Account Registration & Google Sign-In
You may create a parent account on Kidverse Pune using your Google account (via Google Sign-In / Firebase Authentication) or other supported sign-in methods. By doing so, you grant us permission to access your name, email address, and profile picture from your Google account solely for the purpose of creating and managing your Kidverse profile.
You are responsible for maintaining the confidentiality of your account and all activities that occur under it. You agree to notify us immediately at kidversepune@gmail.com if you suspect unauthorised access to your account.
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent behaviour, or pose a risk to other users.
4. Terms for Parents & Users
By using the Platform to discover or book activities for your child, you acknowledge and agree to the following:
- Intermediary Role: Kidverse Pune acts solely as a marketplace. All events, workshops, summer camps, and activities are organised and delivered entirely by independent third-party organisers. We are not a party to any agreement between you and an organiser.
- Independent Verification: Before booking or participating in any activity, you are solely responsible for verifying the event details, the organiser's credibility, safety provisions, age appropriateness, venue legitimacy, and any other relevant factors.
- Bookings & Payments: Any booking confirmed through the Platform constitutes an agreement between you and the event organiser. Payments may be processed through third-party payment gateways. We are not responsible for payment failures, chargebacks, or disputes between you and any payment provider or organiser.
- Cancellations & Refunds: Refund and cancellation policies are set by individual organisers and may vary. Kidverse Pune does not guarantee refunds and is not responsible for resolving disputes related to cancellations, no-shows, or rescheduling.
- Risk Acknowledgement: Participation in physical activities, camps, and events involves inherent risks, particularly where children are involved. By booking or permitting your child to participate, you acknowledge these risks and accept full responsibility for your child's safety and wellbeing during any event.
- Child Information: You may be asked to provide details about your child(ren), including name, date of birth, and gender, to help personalise your experience. You confirm that you have legal authority to share this information and consent to its use as described in our Privacy Policy.
- Prohibited Conduct: You agree not to submit false, misleading, or defamatory reviews or information; attempt to circumvent payment systems; or use the Platform for any unlawful purpose.
5. Terms for Event Organisers
By listing any event, workshop, summer camp, or activity on Kidverse Pune, you confirm and agree to the following:
- Legal Authority: You are legally authorised to conduct and offer the listed activities. All necessary permits, licenses, and regulatory approvals (including those related to child safety and welfare) are in place and current.
- Accuracy of Listings: All event details — including descriptions, pricing, schedules, age groups, venue, and images — are accurate, complete, and not misleading. You agree to update listings promptly if any details change.
- Child Safety: You are solely responsible for ensuring the physical and emotional safety of all child participants during your events. You must have adequate staff, supervision, first-aid provisions, and emergency procedures in place.
- No Verification by Platform: Kidverse Pune does not verify, endorse, or guarantee the legitimacy, quality, or safety of any listed event. Listing on the Platform does not imply any certification or approval by us.
- Payments & Disputes: You are responsible for managing all participant payments, refunds, cancellations, and communications directly unless otherwise agreed in writing. The Platform is not liable for any financial disputes between you and participants.
- Intellectual Property: Any content you upload (text, images, logos, pricing) must not infringe any third-party intellectual property rights. By uploading content, you grant Kidverse Pune a non-exclusive, royalty-free licence to display and promote your listing on the Platform and associated marketing channels.
- Platform Rights: We reserve the right to remove, hide, or decline any listing at our sole discretion, particularly where complaints are received, compliance is in question, or these Terms are breached.
- Independent Contractor: Nothing in these Terms creates any partnership, agency, franchise, employment, or joint venture between the Platform and any organiser.
6. Intellectual Property
All content on the Platform, including its design, logo, name “Kidverse Pune”, text, graphics, and software, is the intellectual property of Kidverse Pune or its licensors and is protected under applicable Indian and international law. You may not reproduce, modify, distribute, or exploit any part of the Platform without express written consent.
7. Limitation of Liability
To the fullest extent permitted under applicable Indian law, Kidverse Pune, its founders, employees, and affiliates shall not be liable for:
- Any injury, illness, loss, damage, or death arising from participation in any listed event or activity.
- Any financial loss, including payment failures, fraud by organisers, or refund disputes.
- Any inaccuracy, omission, or error in event listings provided by organisers.
- Any data loss, service interruptions, or technical failures of the Platform.
- Any indirect, incidental, special, or consequential damages arising from your use of the Platform.
Our total aggregate liability to any user or organiser, if any, shall not exceed the amount actually paid by such party to the Platform in the six months preceding the relevant claim.
8. Indemnification
You agree to indemnify, defend, and hold harmless Kidverse Pune and its founders, directors, employees, agents, and successors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Platform; (b) your violation of these Terms; (c) any event you organise or participate in; or (d) any third-party claim relating to content you post on the Platform.
9. Modification of Terms
We reserve the right to update or modify these Terms at any time. Changes will be communicated by updating the “Last Updated” date at the top of this page. Continued use of the Platform after any such change constitutes your acceptance of the revised Terms. We recommend reviewing this page periodically.
10. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Pune, Maharashtra.
Before initiating any legal proceeding, parties agree to attempt to resolve any dispute through good-faith negotiation for a period of at least 30 days.
